Abstract

The new Brand Law means a total renewal of Spanish brand rights by way of the reception of doctrinal advances, constitutional jurisprudence, and especially international brand rights. The new law protects the registered holder, and at the same time extends guardianship to cover economic and social interests (for example, individual and collective rights and interests of consumers and users) protected by the system of social market economy reflected in our Fundamental Rights.
