Civil Marriage and Canonical Marriage The Need for a Distinction

Abstract

Marriages contracted in civil or religious form, once they have been duly registered in the Civil Register, have the same civil effects. In this regard, the author of this work, professor emeritus of the Faculty of Granada, sticking to the civil marriage and the marriage contracted in canonical form -according to the norms of Canon Law-, proposes the following questions: do these two marriages have the same characteristics, do they carry the same obligations, and, consequently, can the Church recognise the civil marriage as an authentic marriage and, therefore, can the Church recognise the civil marriage as an authentic marriage and, if so, how? Consequently, can the Church recognise the civil marriage as an authentic marriage and accept it as a marriage in its canon law? The article presented here is an attempt to articulate a rigorous response to a subject that has recently aroused social interest.
